Membership Application

1. THE SAND PIT GUN CLUB, LLC (hereinafter "SPGC") is available for all SPGC Members, Immediate Family Members of Members (legal spouses and children of members), and Guests of Members. SPGC is also open to individuals participating in SPGC-approved training classes or events. SPGC Membership is subject to the Membership Terms and Conditions stated herein. Membership will be granted and may be revoked at the sole discretion of SPGC.
2. As part of the consideration for Membership, the Member hereby agrees to remain a Member and pay the Annual or Monthly Fees for a period of 12 Months from the date of this Agreement. The Member will be billed monthly if they do not opt for the reduced annual payment option. SPGC is entitled to recover its costs, including reasonable attorneys' fees, in collecting sums due to SPGC under this or any other Membership provision. Following the first 12 months of Membership, the Member will be continually billed monthly or annually (depending on the Member's original choice). Membership will continue until an SPGC Membership Cancellation Form is submitted.
3. SPGC may review and adjust membership fees and benefits anytime. In the event of a Fee change, the Member will be notified at least 60 days before the change affects them.
4. Monthly Fees (if the Member chose that option) will be an automatic monthly credit/debit payment from a Visa, MasterCard, American Express, or Discover. A $30 fee will be assessed for any automatic debit rejected for insufficient funds or any failed credit charge.
5. All Members, Immediate family members of Member, Guests, and other SPGC facility users must obey the SPGC Range Rules and Regulations and must review, agree to the terms of, and sign the Release and Indemnity Agreement.
6. All Guests must be accompanied by a Member to be admitted to the facility. Members are responsible for all actions taken by their Guests and will hold SPGC harmless for property damage, accidents, and injuries to or caused by Guests.
7. All Members, Immediate family members of Members, and Guests are subject to SPGC's general policies and rules of operation and administration, which are intended to provide a safe, professional, friendly, and family-oriented club.
8. Any Member, Immediate family members of Members, or Guest of a Member may be suspended or expelled from the range and/or facility for violation of the Range Rules and Regulations or for behavior deemed unsafe, unprofessional or unbecoming by SPGC personnel. SPGC's decision regarding suspension or expulsion is final.
9. A Membership may be unilaterally terminated by SPGC if, in the sole discretion of SPGC management, the conduct of a Member, Immediate family members of Members, or the Member's Guest presents a safety hazard to the Member or to any other user or employee of SPGC or to SPGC facilities.
10. The Membership shall be considered "abandoned" and terminated if the Membership Fee(s) is unpaid for 30 consecutive days.
11. Any destruction of SPGC property caused by a Member, Immediate family members of Members, or a Member's Guest, whether accidental, negligent, willful, or otherwise, may result in the violator being removed from the range and/or facility, suspended or removed from Membership of a Member, and/or criminally prosecuted. In addition, SPGC reserves the right to assess to the Member a reasonable charge for any such damage, regardless of whether the damage is caused by the Member, Immediate family members of Members, or the Member's Guest.
12. Member privileges and expectations include:
1. As a member of SPGC, you will have access to the entire facility from 8 AM to 7 PM (shooting hours are from 9am to 6pm).
2. All members MUST schedule range time through the website through "bay bookings." Members must attend their bay bookings promptly at the start and be off the range upon the conclusion of their bay reservation if another member is slotted to train after them.
3. All equipment and targets are the property of SPGC and may be used by its members only at the training center. Before leaving the facility, all equipment and targets must be returned to their proper locations as found.
4. All activities and training should be conducted at your own risk, and all safety precautions should be considered.
5. All members are responsible for the actions of their immediate family members and guests.
6. Member "Family Guests" (legal spouses and children of members) may attend anytime while accompanying the SPGC member for a $20 fee per guest/day.
7. Member "Non-Family Guests" (any person other than legal spouses and children of members) may attend up to 5 times per year (12 consecutive months) while accompanying the SPGC member for a $50 fee per guest/day.
8. Children of members 18yrs old or older will be treated as "Non-Family Guests".
9. All members are responsible for ensuring SPGC Range Rules, Regulations, and Release and Indemnity Agreement are completed every visit for their immediate family members and guests.
10. All members MUST treat everyone with respect. We will not tolerate disrespectful behavior between members and authorized users of SPGC and encourage all members to notify management of unwanted or unsafe behaviors.
11. All members are responsible for security to the member area(s) and member use equipment.
12. No sharing of security codes/cards or gate codes with anyone.
13. Light must be shut off after leaving the building.
14. No smoking inside the building or out back near the propane tank. All cigars or cigarette butts, or remnants must be moved and not discarded on the grounds.
15. No alcohol consumption will be permitted on the property outside of SPGC training events after-hours sessions.
16. Absolutely NO DRUGS or drug usage on the property.
17. No fires will be permitted outside of controlled burn pits & barrels.
18. Eye protection must be worn at ALL TIMES while on the ranges.
19. Ear protection must be worn at ALL TIMES while on the ranges.
20. No pets are allowed on the property.
21. No off-roading.
22. No primitive camping without expressed permission from SPGC Management.
23. No green tip M855 or armor penetrating rounds are to be shot on steel targets.
24. Minimum distance for shooting rifle on steel is 25yd and 10yd with pistol no exceptions.
25. No loaded weapons are to be handled or manipulated off the firing line or outside the training bays.
26. Members will pay for any damages or losses in equipment or against property.
27. SPGC reserves the right to shut down any/all of the facilities to accommodate maintenance, large events, or for whatever reason SPGC, in its sole discretion, determines.
13. All Members must allow their photograph to be taken for SPGC records or identification.
14. Memberships may not be transferred or sold.

1. FIREARMS & TARGETS
   1. All firearms brought into any SPGC facility must be UNLOADED, except for personal defense firearms carried:
   1. In compliance with the NEW JERSEY Revised Code.
   2. All such personal defense firearms shall remain holstered until the person carrying the firearm is on the firing line.
   3. All firearms, accessories, ammunition, and targets are subject to inspection and approval by the Range Safety Officer (RSO).
   4. The minimum distance for shooting a rifle on steel is 25 yards, and with a pistol, it is 10 yards, with no exceptions.
   5. Targets may be used on the range ONLY if approved by the RSO.
   6. NO explosive targets are to be used.
2. RANGE SAFETY OFFICER (RSO)
1. The RSO(s) on duty is/are in direct charge of the range and all activities taking place on the range at all times.
2. All persons on, or entering, the range shall follow the instructions/directions of the RSO.
3. Any RSO, at the RSO's sole discretion, may:
1. Ban from the range and/or any SPGC facility any person who handles a firearm in an unsafe or careless manner; and
2. Terminate a member's membership should said member's conduct warrant.
3. RANGE PROCEDURE
1. Eye and hearing protection shall be worn by all persons entering the range and shall be put on before entering the range. NO EXCEPTIONS.
2. Appropriate dress is required at all times.
3. Absolutely no drugs or drug use on SPGC property. No one who has consumed alcohol or non-doctor-prescribed drugs may handle a firearm on SPGC property.
4. Persons who, at the sole discretion of SPGC, are deemed to be a safety concern (including, but not limited to, persons believed to be under the influence of alcohol or drugs) shall be required to leave the facility. SPGC reserves the right to refuse service to anyone.
1. All SPGC members are fully responsible for the actions of their immediate family members and guests.
5. The order to "CEASE FIRE" or "CEASE FIRING" means:
1. STOP SHOOTING;
2. All shooters: REMOVE FINGERS FROM TRIGGERS;
3. Each shooter: PLACE FIREARM ON THE BENCH in the shooter's lane with MUZZLE POINTED DOWNRANGE;
4. Everyone STEP BACK from the firing line.
6. No firearm handling is permitted behind the firing line.
1. All firearms shall be uncased on the firing line.
2. No loaded weapons are to be handled or manipulated off the firing line or outside of the training bays.
7. A responsible adult member must accompany each person under eighteen (18) years of age onto the range. This adult member shall act as a coach, and MUST remain with the minor at all times while the minor uses the range.
8. Each firearm's muzzle must be pointed down range at all times.
9. If a mechanical malfunction occurs request assistance from the RSO.
1. If you cannot clear a jammed or malfunctioning firearm, DO NOT REMOVE JAMMED OR MALFUNCTIONING FIREARMS from the firing line.
2. Contact the RSO immediately for assistance.
10. Only "line of sight" firing is permitted. Keep your finger off the trigger until you have a sight picture on target.
11. When leaving the firing line temporarily:
1. Unload and clear all the firearms that are in your lane.
2. Lay all firearms down on the bench in your lane with muzzle pointed down range and action open.
3. Leave all firearms' actions up so that the empty chambers can be observed by the RSO.
12. Upon completion of shooting session:
1. Unload and clear all firearm(s).
2. Leave all action(s) open.
3. Case, or prepare firearms for transport, in your lane.
4. VANDALISM
1. Any shooter seen, or determined to have been, firing at anything other than the targets in that shooter's lane (including but not limited to lights, baffles, carriers, or any other range property, or equipment) will have his/her membership suspended, if any, and will be reported to the proper authorities for appropriate action.
1. Each shooter will be liable for any and all damage caused by said shooter, including but not limited to the costs of replacement and installation associated with said damage.
2. Firing at anything other than approved targets is prohibited.
3. Only targets approved by the RSO will be permitted.
5. PERMISSIBLE FIREARMS
1. SPGC reserves the right, in its sole discretion, to refuse to allow the use of any specific firearm at any SPGC facility.
2. All firearms must be in compliance with all applicable federal, state, and local laws.
3. Shotguns are allowed at the sole discretion of the Chief RSO. Slugs, 00 buckshot or larger only are allowed.
4. All air guns and BB guns are allowed at the sole discretion of the RSO.
5. The use of 50 caliber or equivalently sized ammunition is NOT permitted.
6. For firearms not covered here, check with the Chief RSO prior to use.
6. PERMISSIBLE AMMUNITION
1. All ammunition is subject to inspection and approval by the RSO.
2. In most cases, standard commercial and reloaded ammunition is permitted with the following exceptions:
1. Shotguns must shoot 00 buckshot or slugs, NO birdshot.
2. NOT PERMITTED: Any ammunition designed for penetrating metal.
3. NOT PERMITTED: Steel shot, and/or steel jacketed/core projectiles, such as Wolf or Tulammo.
4. NOT PERMITTED: Tracer, incendiary, armor piercing, gas, or explosive ammunition.
5. NOT PERMITTED: Green tip or steel.
7. BRASS RETRIEVAL
1. Shooters are permitted to collect their brass with the following exceptions:
1. Shooters are NOT permitted to take brass left by other shooters.
2. Brass may only be retrieved when there is no one else firing on the range.
3. Members and their guests must retrieve their brass and deposit it in the appropriate containers providing the member is not reclaiming their brass.
8. EYE PROTECTION: Safety glasses are MANDATORY when entering the range.
9. HEARING PROTECTION: Hearing protection is MANDATORY when entering the range.

I, the undersigned, for myself and on behalf of my representatives, assigns, heirs, executors, and administrators, in consideration for THE SAND PIT GUN CLUB LLC (hereinafter “SPGC”) allowing me to use its facilities, including the firing range, training facility, weight room and to participate in, or observe, any other activities/programs, including, but not limited to, firearms instruction and training, test firing, firearms rentals (if any), and demonstrations (together the “Activities”), having perceived, appreciated, and assumed the risk inherent in firearms operation, lead exposure, and the Activities including, but not limited to, the possibility of personal or property injury, permanent disability, and/or death due to accidental discharge; equipment malfunction and/or failure; ricochet; misunderstanding of instructions; omission or error on the part of instructors, range/safety officers, and/or other participants in the Activities; and/or actions of other participants in the Activities I do hereby agree as follows:

1. I hereby FULLY RELEASE, INDEMNIFY, HOLD HARMLESS, AND DISCHARGE: SPGC and all other persons and organizations associated with SPGC including, but not limited to, its owners, directors, officers, associates, employees, representatives, trainees, trainers, instructors, range/safety officers, gunsmiths, affiliates, agents, and members (together the “Released Parties”) with regard to any and all claims, liabilities, and expenses (including attorney’s fees) related in any way to my participation in the Activities.
2. I certify that I have read and understand the RANGE RULES AND REGULATIONS of SPGC (hereinafter “Rules”) and agree to abide by said Rules and all instructions given by range/safety officers. I understand and agree that my failure to abide by any rule or instruction may result in my immediate removal from the range and expulsion from the Activities and the SPGC facility. I will, at all times, exercise safe firearm handling practices and will not operate any firearms or equipment with which I am not completely familiar. If I am a member of SPGC, I understand that I am fully responsible for the actions of my immediate family members and guests.
3. I certify that:
1. I have answered all the questions on this form truthfully, completely and accurately;
2. I have been advised that I have the right for my own legal counsel to review this Release and Indemnity Agreement;
3. I have no medical, mental or physical conditions that could compromise my safety and/or the safety of others in any of the Activities;
4. I am not currently under the influence of alcohol and/or drugs (of any kind or classification), and I am not impaired in any way that would affect my ability to safely participate in the Activities;
5. I have adequate insurance to cover any injury or damage I may cause or suffer, or else I agree to bear the costs of such injury or damage personally;
6. I can lawfully possess and/or control firearms under federal, state, and local laws and regulations;
7. I am not a “Prohibited Person” under federal law.
4. I consent to be financially responsible for and to reimburse SPGC for any action on my part (including, but not limited to, the discharge of a firearm) that causes damage to the range or equipment. I agree that I shall be liable for all costs, including attorney’s fees, associated with the enforcement of this RELEASE AND INDEMNITY AGREEMENT.
5. This RELEASE AND INDEMNITY AGREEMENT shall be governed by the laws of the State of NEW JERSEY. The venue for any cause of action related to this Agreement shall be a court of competent jurisdiction in Licking County, NEW JERSEY.
6. Young Adults: If the participant is a young adult who is age eighteen (18) years old or older but has not yet reached the age of twenty-one (21) years old, the participant acknowledges that the participant will only be permitted to possess and/or control rifles and shotguns, at any SPGC facility, that the National Firearms Act does not regulate.

I have fully and carefully read this RELEASE AND INDEMNITY AGREEMENT, as well as any and all Rules, and understand its contents. I am aware that this is a release from liability and indemnification agreement and a contract between the Released Parties and me and that this Agreement imposes limitations on my legal rights. I sign this RELEASE AND INDEMNITY AGREEMENT of my own free will and with the intent to be legally bound by the terms set forth herein.

Consent for Minor: If the participant is a minor who has not yet reached the age of eighteen (18) years old, the undersigned warrants that she/he is the natural or adoptive parent or is the legal guardian of said minor and that the undersigned for him/herself, and on behalf of the minor and the minor’s representatives, assigns, heirs, executors, and administrators, agrees to be legally bound the terms set forth herein and to be liable for any and all damages caused by said minor, if any.

Consent for Young Adult: If the participant is a young adult who is age eighteen (18) years old or older but has not yet reached the age of twenty-one (21) years old, the undersigned warrants that he/she is the natural or adoptive parent, or is the legal guardian of said young adult and that the undersigned: (a) authorizes said young adult to use/shoot one or more pistols/handguns, and (b) for him/herself, and on behalf of the young adult and the young adult’s representatives, assigns, heirs, executors, and administrators, agrees to be legally bound the terms set forth herein and to be liable for any and all damages caused by said young adult, if any.
